Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ParkSaver mobile application ("App") or the parksaver.app website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Site.

These Terms form a binding legal agreement between you and the independent developer operating ParkSaver ("we," "us," or "our"). If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

ParkSaver is a parking cost planning application that helps users understand tiered parking tariff structures at Malaysian shopping malls and plan their parking sessions to minimise costs. The App provides:

  • Parking cost calculations based on community-maintained tariff data
  • Smart Break reminders (scheduled push notifications)
  • Parking session history
  • Community tariff contribution tools

ParkSaver is an informational and planning tool only. We do not control, operate, or have any affiliation with any shopping mall, car park, or parking operator. All tariff data in the App is provided on a best-efforts basis by the community and may not reflect current, accurate, or complete pricing.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use ParkSaver. By using the App, you represent that you meet this requirement.

4. Account Registration

4.1 Anonymous use

You may use ParkSaver without creating an account. An anonymous session is created automatically on first launch. Anonymous sessions are tied to your device and may be lost if you uninstall the App or reset your device.

4.2 Account creation

You may optionally create an account with an email address and password, or sign in with Apple (iOS) or Google. An account enables cross-device sync and subscription restoration.

4.3 Your responsibilities

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us immediately at support@parksaver.app if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

5.1 Free trial period

From May 15, 2026 to August 15, 2026 (the "Free Trial Period"), all features of ParkSaver are available at no charge. No payment method is required during this period. The end date of the Free Trial Period will not be shortened, but may be extended at our discretion.

5.2 Paid subscription

After the Free Trial Period, access to core features requires a paid subscription. Subscription options and pricing are displayed within the App at the time of purchase. Pricing may change; existing subscribers will be notified in advance.

Current plans (subject to change):

  • Monthly — RM 5/month
  • 6-month — RM 25
  • Annual — RM 45/year
  • Founding Member — RM 35/year (limited time, available during or shortly after launch)

5.3 Billing and payment processing

All payments are processed by Apple (iOS) or Google (Android) through their respective app store billing systems. We never see or store your payment card details. Your purchase is subject to Apple's or Google's terms and conditions in addition to these Terms.

5.4 Auto-renewal

Subscriptions auto-renew at the end of each billing period unless cancelled. You may cancel at any time through the App Store or Google Play. Cancellation takes effect at the end of the current paid period — you retain access until then.

5.5 Refunds

Refund requests are handled by Apple or Google in accordance with their refund policies. We do not process refunds directly. Contact Apple Support or Google Play Support for refund requests.

5.6 Restore purchases

You may restore a previous subscription purchase at any time via Settings → Restore Purchases in the App. This is required by Apple's App Store guidelines and is available on both platforms.

5.7 Price changes

If we change subscription pricing, existing active subscribers will be notified at least 30 days in advance and will be grandfathered at their existing price for the current subscription product. Price changes apply to new purchases and renewals after the change.

6. Acceptable Use

You agree not to:

  1. Use ParkSaver in any way that violates applicable laws or regulations.
  2. Reverse engineer, decompile, or attempt to extract the source code of the App.
  3. Use the App to scrape, harvest, or bulk-collect tariff data or other content.
  4. Submit false, misleading, or malicious tariff data to the community database.
  5. Attempt to circumvent, disable, or interfere with any security or access-control feature of the App.
  6. Use automated tools (bots, scrapers) to access the App or its backend services.
  7. Resell, sublicense, or commercially exploit the App or its content without our written permission.
  8. Impersonate another person or create fraudulent accounts.

We reserve the right to suspend or permanently ban accounts that violate these rules, without prior notice and without refund.

7. Community Tariff Data

7.1 Contributions

Users may contribute parking tariff information (rates, zone names, schedules) to the shared database. By submitting tariff data, you:

  • Represent that the information is accurate to the best of your knowledge
  • Grant us a perpetual, royalty-free licence to use, display, and distribute the data as part of the ParkSaver service
  • Understand that submissions are anonymous and cannot be individually retracted once integrated into the database

7.2 Accuracy disclaimer

Tariff data is provided by community contributors and is not verified by us. Parking rates can change at any time without notice. Always confirm actual charges on the car park's rate board or payment terminal. We are not responsible for differences between data shown in the App and charges you actually incur.

8. Accuracy of Calculations

ParkSaver's cost calculations are based on the tariff data in our database and the session details you provide. Calculations are estimates only. Actual parking charges may differ due to:

  • Outdated or incorrect tariff data
  • Special promotions, validation, or discount schemes at the mall
  • Grace periods or rounding rules applied by specific car park systems
  • Public holidays or weekends where different rates apply

We are not liable for any parking charges you incur, regardless of whether you relied on calculations provided by the App. Always verify charges at the payment terminal before leaving the car park.

9. Intellectual Property

9.1 Our content

The ParkSaver name, logo, app icon, design, code, and all content we create are our property or licensed to us. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

9.2 Your content

You retain ownership of any content you contribute (e.g. tariff data, feedback). You grant us the licence described in Section 7.1 for tariff contributions.

9.3 App Store terms

Your use of the App is also subject to the Apple App Store Terms of Service (iOS) or Google Play Terms of Service (Android), as applicable.

10. Privacy

Your use of ParkSaver is subject to our Privacy Policy, available at https://parksaver.app/privacy and within the App under Settings. The Privacy Policy is incorporated into these Terms by reference.

11. Disclaimers

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We do not warrant the accuracy, completeness, or timeliness of any tariff data or calculation within the App.
  • We are not affiliated with, endorsed by, or responsible for any shopping mall, car park operator, or parking authority.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or goodwill
  • Parking charges, fines, or penalties you incur
  • Any damages arising from your reliance on tariff data or calculations in the App
  • Any damages exceeding the amount you paid us in subscription fees in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

13. Indemnification

You agree to indemnify, defend, and hold harmless ParkSaver and its developer from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your use of the App in violation of these Terms
  • Your submission of inaccurate or malicious tariff data
  • Your violation of any third party's rights

14. Termination

14.1 By you

You may stop using the App at any time and delete your account via Settings → Account → Delete Account. Deleting your account terminates these Terms with respect to your use, subject to any provisions that survive termination.

14.2 By us

We may suspend or terminate your access to the App at any time, with or without notice, if:

  • You breach these Terms
  • We discontinue the App
  • Required by law

If we terminate for reasons other than your breach, we will provide a pro-rated refund of any unused prepaid subscription period where required by law or app store policies.

14.3 Effect of termination

Upon termination, your right to use the App ceases. Sections 7.1, 9, 11, 12, 13, and 15 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the App will be resolved by negotiation in good faith first. If unresolved within 30 days, disputes may be submitted to the courts of Malaysia with jurisdiction, which you and we agree to accept as exclusive jurisdiction for such disputes.

For App Store purchases (iOS): Apple's Standard EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) supplements these Terms. In the event of a conflict, Apple's EULA prevails for App Store-specific matters.

16. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. For material changes, we will notify you via the App or by email (if you have an account) at least 14 days before the change takes effect. Continued use of the App after the effective date constitutes your acceptance of the updated Terms.

17. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
  • No waiver: Our failure to enforce any right or provision is not a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
  • Language: These Terms are written in English. If translated, the English version prevails in case of conflict.
